Article 1 - Purpose and scope

These General Terms and Conditions of Sale and Use govern the sales of sports equipment made by the company SARL SAVAGERS COMPANY on its website espacesport.fr to individual customers (consumers).

Placing an order on the site implies the buyer's full and unreserved acceptance of these terms and conditions.

Article 2 - Prices

Our product prices are indicated in euros, including all taxes (VAT and other applicable taxes on the day of the order), excluding processing and shipping fees.

In the event of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties, local taxes, import duties, or state taxes may be payable. These duties and sums are not the responsibility of the company SARL SAVAGERS COMPANY and are entirely at your expense.

The company SARL SAVAGERS COMPANY reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rates in force at the time of the order validation, subject to availability.

The products remain the property of the company SARL SAVAGERS COMPANY until full payment of the price.

Attention: as soon as you (or a third party designated by you) take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.

The contractual information is presented in French and will be confirmed at the latest when the order is validated.

The company SARL SAVAGERS COMPANY reserves the right not to register a payment and not to confirm an order for any reason whatsoever, particularly in the event of a supply problem, a dispute regarding a previous order, or any abnormal difficulty concerning the order received.

Article 4 - Order validation

Any order validated on the site [http://www.espacesport.fr](http://www.espacesport.fr) constitutes full and complete acceptance of these General Terms and Conditions. All data provided and the registered confirmation will serve as proof of the transaction. A summary of your order information will be sent to you by e-mail.

Article 5 - Payment

Purchases can be paid for by credit card or bank transfer via the secure systems Stripe or PayPal. The card is charged at the time of order validation.

Article 6 - Right of withdrawal

In accordance with the provisions of Article L.221-18 of the Consumer Code, you have a period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.

Returns must be made in their original condition and complete (packaging, accessories, manual). Any damage suffered by the product on this occasion may prevent the exercise of the right of withdrawal. Return costs are your responsibility.

In the event of exercising the right of withdrawal, the company SARL SAVAGERS COMPANY will reimburse the sums paid within 14 days of the notification of your request, using the same payment method as that used for the order.

Exceptions: The right of withdrawal is excluded for goods made to your specifications or clearly personalized, goods unsealed after delivery which cannot be returned for reasons of hygiene or health protection, etc. (in accordance with Article L.221-28 of the Consumer Code).

Article 7 - Availability

Our product offers are valid as long as they are visible on the site and within the limits of available stocks. In the event of a product being unavailable after your order is validated, you will be informed by e-mail: the order will be automatically cancelled and no payment will be taken.

The company SARL SAVAGERS COMPANY reserves the right to refuse orders for an abnormally large quantity (more than 50 identical items).

Article 8 - Delivery

The products are delivered to the address indicated during the ordering process. In case of late delivery, you have the right to cancel as provided for in Articles L.216-2 and following of the Consumer Code.

Delivery is free for purchases of €50 or more in mainland France (excluding Corsica).

Article 9 - Legal and contractual guarantees

All our products benefit from the legal guarantee of conformity (Articles L.217-4 and following of the Consumer Code) and the guarantee against hidden defects (Articles 1641 and following of the Civil Code).

Legal guarantee of conformity: The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. In case of a defect, you may choose between repair and replacement of the good (unless it is disproportionately costly). This action is time-barred after two years from the delivery of the goods.
Guarantee against hidden defects: The seller is liable for the warranty against hidden defects of the item sold which render it unfit for the use for which it was intended. The action must be brought within two years from the discovery of the defect.

Contractual guarantee: The products also benefit from the manufacturer's warranty indicated on each product sheet. Failures linked to normal wear and tear, improper installation, failure to follow instructions, or unauthorized professional use are excluded.

Article 10 - Liability

The liability of the company SARL SAVAGERS COMPANY cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered, or in the event of misuse of the purchased product. The company declines all responsibility inherent in the use of the Internet (service interruption, intrusion, virus).

Article 11 - Assembly of devices

The contractual guarantee does not cover the installation and assembly of the product, which is carried out under the sole responsibility of the customer. The customer agrees to read carefully the instructions for use and assembly provided before any handling. The carrier is not required to assemble the equipment.

Article 12 - Intellectual property

All elements of the espacesport.fr site (texts, software, visuals, sounds) are the exclusive intellectual property of the company SARL SAVAGERS COMPANY. Any unauthorized reproduction or use is strictly prohibited.

Article 13 - Personal data

The information collected is necessary for the management of your orders and the monitoring of customer relations. In accordance with the "Data Protection" Act and the GDPR, you have a right of access, rectification, and opposition regarding your personal data directly from the website.

Article 14 - Applicable law and disputes

These terms and conditions of sale and use are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing this, the competent courts will be determined in accordance with the legal rules of jurisdiction applicable to consumers in France.

Article 15 - Proof Archiving

The company SARL SAVAGERS COMPANY will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

The computerized registers of the company SARL SAVAGERS COMPANY will be considered by all parties concerned as proof of the communications, orders, payments, and transactions that took place between the parties.

Failing an amicable resolution, the dispute will be brought before the Vannes High Court (Tribunal de Grande Instance).
